By accessing, downloading, installing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Smartish AI provides an artificial-intelligence-assisted product discovery, price comparison, deal aggregation, search history, wishlist, and notification platform. The Service is designed to help end users identify products, compare publicly available or otherwise accessible marketplace listings, save preferences, and receive optional alerts. Smartish AI is not a seller, merchant, marketplace operator, payment processor, logistics provider, warranty provider, or manufacturer. We do not take title to goods, do not warehouse inventory, do not process checkout transactions on behalf of merchants, and do not guarantee the accuracy, availability, pricing, authenticity, shipping timelines, returns policies, or stock status of any third-party listing.
You must be at least 13 years of age (or the higher age of digital consent required in your jurisdiction) to use the Service. By creating an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for safeguarding your credentials and for all activity occurring under your account. You must promptly notify us of any unauthorized use. We may refuse registration, reclaim usernames, or require additional verification at our discretion.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes (or internal business evaluation where expressly permitted). You agree not to:
You may submit images, product links, queries, wishlist items, feedback, and related content (“User Content”). You retain ownership of your User Content, but you grant Smartish AI a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use User Content solely as needed to operate, improve, secure, and support the Service. You represent that you have all rights necessary to submit User Content and that such content does not violate law or third-party rights. We may remove or refuse User Content that we reasonably believe violates these Terms.
Product titles, prices, discounts, images, availability, and related fields displayed in the Service are informational only and may be incomplete, delayed, localized, approximate, or inaccurate. Marketplace data can change without notice. Always verify final purchase terms, taxes, shipping, returns, and total cost on the merchant’s website or application before completing any transaction. Clicking “View Deal,” store links, or similar controls typically redirects you to third-party destinations outside our control. Smartish AI is not a party to any transaction between you and a merchant.
Portions of the Service rely on automated systems and third-party artificial-intelligence providers to extract, clean, rank, normalize, and rearrange product metadata. AI outputs may be incomplete, outdated, approximate, or incorrect. Prices, discounts, availability, and product attributes can change without notice on merchant websites. You should not treat AI-rearranged fields as a guarantee of merchant terms. We do not warrant that AI outputs will always perfectly match source pages.
If you enable push notifications or otherwise consent to receive messages, we may send transactional, deal, update, or system communications. You can manage notification permissions through your device settings and, where available, in-app controls. Message delivery depends on third-party push infrastructure and is not guaranteed. You remain responsible for reviewing message content and for any actions you take based on alerts.
The Service, including its software, design, trademarks, logos, documentation, and other materials (excluding User Content and third-party marketplace content), is owned by Smartish AI or its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. You may not use our branding in a manner that implies endorsement without prior written consent.
The Service may integrate or link to authentication providers, hosting providers, push notification services, artificial-intelligence providers, analytics tools, and online marketplaces such as Amazon, Flipkart, Myntra, AJIO, Meesho, Croma, and others. Your use of third-party services is governed by those parties’ terms and privacy policies. We are not responsible for third-party content, availability, security, or practices.
The Service may be offered free of charge or under future paid plans. We reserve the right to introduce fees, change features, impose usage limits, or discontinue parts of the Service with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation. Temporary outages may occur due to maintenance, network issues, vendor failures, or circumstances beyond our reasonable control.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT SEARCH RESULTS OR DEAL INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTISH AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (OR LOCAL EQUIVALENT), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You agree to defend, indemnify, and hold harmless Smartish AI and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may suspend or terminate access to the Service, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or for operational reasons. You may stop using the Service at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
You may request deletion of your account and associated personal data by submitting a request through our account deletion request form or by contacting us as described in the Privacy Policy. Submitting a request does not delete your account immediately; it records your request for administrative review and processing. Verified requests will be actioned within a reasonable period, subject to legal retention requirements, security logs, and ordinary backup cycles. Related records such as searches, wishlist items, notifications, notification read-state, messaging tokens, and tracking events associated with your account may be removed as part of that process once the request is approved and completed by an administrator.
These Terms shall be governed by the laws applicable in the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence require otherwise. Courts located in that jurisdiction shall have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have to bring claims in your local courts. Nothing in these Terms limits non-waivable consumer rights.
We may update these Terms from time to time to reflect operational, legal, or product changes. The “Last updated” date and version label at the top will change when material revisions occur. Where required by law, we will provide additional notice. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms to the maximum extent permitted by law. If you do not agree, you must stop using the Service and may request account deletion.
These Terms, together with the Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and Smartish AI regarding the Service and supersede prior agreements on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms do not create a partnership, joint venture, employment, or agency relationship. Headings are for convenience only.
This document is drafted in English. If translated, the English version controls unless local law requires otherwise.
